The Olympia Brewery site is a historic and culturally significant location that reflects both the region’s industrial heritage and ongoing efforts toward sustainable redevelopment.
Challenge
A three-alarm blaze in 2018 destroyed a significant portion of the building, and a 2019 incident involving a vandalized transformer led to about 600 gallons of oil tainted with toxic polychlorinated biphenyls (PCBs) spilling into the Deschutes River, which flows into Puget Sound. The spill triggered a state-led cleanup that relied on divers suctioning up contaminated sediment underwater, and other labor-intensive measures. The cleanup costs exceeded $10 million. The property owner defaulted on its service agreement with the environmental sciences and cleanup firm. Under the service agreement, the property owner executed and delivered a Deed of Trust in favor of the environmental firm. The firm sought collection through petitioning the Court to appoint JFP Partners (formerly J. Fanelli Properties, LLC) to prepare a liquidation plan to recover the consulting firm’s fees.
